Terms and conditions – Unlikely Allies 2017

I. Scope

The following terms and conditions apply to the sale of entry tickets for, and the relationship during the Unlikely Allies event hosted by Impact Hub in Berlin on May 18-19 (hereinafter referred to as Tickets).

All agreements are concluded between the purchaser of such Tickets (hereinafter referred to as “customer”) and Impact Hub GmbH (a charitable company established and registered in Vienna, Austria under FN 358967v, Lindengasse 56/18-19, 1070 Vienna) (hereinafter referred to as “Organiser”). Impact Hub Berlin GmbH’s involvement during the payment procedure does not constitute a position as a contract partner, but instead takes place in the name and order of the Organiser.

II. Contract conclusion

The contract will be concluded when Organiser collects or debits the payment, or in the case that such a process is automated when the payment is actually received. Customer hereby waives its right to receive any acceptance of the order.

III. Contract fulfilment by Customer
The prices of Tickets are shown during the ordering procedure by Eventbrite. The prices shown on the website at the time the purchase order is placed shall be definitive. The purchase price shall be due for payment immediately upon conclusion of the contract.

IV. Contract fulfilment by Organiser
Following receipt of payment in full by the Organiser, the Organiser shall forward the tickets to the customer at his specified email address. It is not necessary to bring the tickets to the event.

Please note the ticket fee does not include travel or hotel accommodation costs unless otherwise stated

A tax receipt will be automatically created by the registration system and issued at the point of booking. Receipts will be sent via email to the person or organisation making the booking.

V. Cancellation Policy

1. Consumers only
In the event of Customer being a consumer as defined in § 13, BGB [German Civil Code], Customer will have the right to cancel within 14 days, without stating any reason, his or her declaration of intent to conclude a contract by sending an email to [●]. For the said deadline to be deemed observed, it will be sufficient for the cancellation form to be sent in due time, or for the said declaration to be issued to Messe München in due time. The period for cancellation will commence upon conclusion of the contract.

2. All customers
For cancellations up to 30 days before the event (prior to April 18th) – Organiser will refund 50% of the price paid (less cancellation processing fee of EUR 50.00 per ticket)

In the case of unavoidable cancellation of the event itself due to force majeure or circumstances beyond our control, Organiser will refund the price paid (less cancellation processing fee of EUR 50.00 per ticket). In these circumstances, Organiser does not accept responsibility or liability for any additional costs incurred by the ticket purchaser, such as accommodation or travel cancellation fees.

Ticket cancellations requested within 30 days of the event will not be refunded for any reason.

No-shows will not be refunded for any reason.

VI. Warranties

Organiser will endeavour to ensure that the yet to be sent program remains correct at the time of the event. Organiser may however need to alter the program prior to or during the event and reserve the right to do so without notice.

Organiser also reserves the right to postpone (in which case credit notes will be issued) or cancel this event (in which case full refunds will be issued – less administration fee of EUR 50.00 per ticket).

VI. Liability

The liability of the Organiser, including that of his legal representatives and vicarious agents, is limited to intent and gross negligence. Organiser’s liability for damages resulting from death, physical injury or health impairment caused by negligent breach of duty by the Organiser or malicious or negligent breach of duty by a legal representative or agent of the Organiser shall be excluded from the above limitations of liability.

Organiser is not responsible for any additional loss or damage as a result of a substitution, alteration, postponement or cancellation of the event, nor for any other losses incurred at the event.

VII. Data Protection

The Organiser will protect the personal data of the customer and will take any measures required for the customer’s safety. The data will be collected and utilised by Organiser in compliance with the provisions of the German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG), the German Telemedia Act (Telemediengesetz, TMG) as well as any further relevant data protection regulations.

Organiser collects personal data from customers at the point of registration and at other points via the event website, email and telephone calls. This information is used solely for internal marketing purposes and for the production of the event you have registered for. The only occasion when personally identifiable information is shared with third parties is when particular event attendee lists are made available to other attendees and sponsors of the same event. In those cases, the individual is given the opportunity to opt out during his or her event registration.

The customer may revoke any use of his or her data at any time by sending an email to martin.wild[at]impacthub.net.

VIII. Photographs and recordings

The customer hereby expressly confirms his agreement that the Organiser shall have the right to take photographs or make recordings of the customer before and during the entire event, and to publish, disseminate and circulate the same on the Internet, in print media and other media.

IX. Place of jurisdiction
Unless the customer is a consumer, the place of jurisdiction for any and all legal disputes arising from the contract shall be Berlin.

X. Applicable law
Unless the customer is a consumer, the laws of the Federal Republic of Germany shall be exclusively applicable; the United Nations Convention on Contracts for the International Sale of Goods shall be excluded.

XI. Concluding provision
If one or more provisions in this contract should be or become invalid in whole or in part, the remainder of the contract shall remain in force. Any invalid provisions shall be replaced by provisions which come as close as possible to the objective intended by the parties.
